By using the services provided on igaming.domains The Buyer acknowledges that The Buyer has read, understood and agreed to these terms, including, but not limited to, the Domain Buyer Agreement, Disclaimer of Warranties and Limitation of Liability.
Monetise Internet Group Holdings Limited (hereinafter We) reserves the right to change any of these terms, at any time, without any prior notice to The Buyer. We reserve the right, in our sole discretion, to refuse the usage our services to The Buyer, as well as to restrict, suspend and/or terminate The Purchase of any domain(s), listed on igaming.domains, without any liability to our company. The Purchase of a domain name or a number of domains at once (hereinafter The Purchase) is considered to be made, when the payment has been completed.
Domain Buyer Agreement
When making The Purchase on igaming.domains, a Domain Buyer Agreement is considered being reached between The Buyer and Monetise Internet Group Holdings Limited, according to the following terms:
• The Buyer agrees to make a research on domain(s) of interest before The Purchase, in order to ensure that the domain name does not infringe any ownership and/or any trademark rights;
• The Buyer agrees to not hold liable Monetise Internet Group Holdings Limited, its shareholders, directors or employees, if The Buyer failed to perform a research on the conflicting rights for the domain(s) that The Buyer acquired on igaming.domains;
• The Buyer agrees to be fully responsible for renewing the domain names with their domain registrar or any other domain registration authority before the expiration date;
• The Buyer understands and agrees that by making The Purchase on igaming.domains, The Buyer automatically enters into a legally binding contract to purchase the domain(s);
Publication Rights
The Buyer agrees that Monetise Internet Group Holdings Limited has the right to publish the names of domains sold as well as the purchase prices on igaming.domains or in any other place for promotional purposes.
The Buyer has the right to object to the publication, as stated above. The objection should be submitted to us by e-mail before the completion of the domain transfer in order to be valid.
Payment Methods and Currency
In order to pay for a domain name bought on igaming.domains The Buyer should use Escrow.com. For alternative methods of payment, please, contact us at [email protected].
While igaming.domains doesn’t charge any fee to The Buyer, we are not responsible for any fees charged by payment provider (Escrow) and/or any other costs imposed by third parties, when the payment is being made. All fees that concern the transfer of funds through Escrow.com are being paid by The Buyer.
igaming.domains parent company Monetise Internet Group Holdings Limited reserves the right to change the payment methods on igaming.domains at any time, as well as adding supplemental charges, with immediate effect upon the changes being posted on igaming.domains.
Euro will be the only currency used for all payments on igaming.domains. The Buyer will pay any currency exchange fees to third parties, if those apply.
Confidentiality
igaming.domains keeps all information and data about The Buyer strictly confidential. The Buyer igaming.domains acknowledges that by buying domains on igaming.domains, they may acquire confidential information about igaming.domains business. The Buyer agrees to take reasonable precautions to safeguard the confidentiality of this information and to not disclose it to anyone without the permission from Monetise Internet Group Holdings Limited.
Intellectual Property Rights
The Buyer agrees that Monetise Internet Group Holdings Limited holds all rights, title and interest in the services offered on igaming.domains and all intellectual property, including other rights related to intangible property, unless otherwise indicated.
The Buyer acknowledges that no title or interest in such intellectual property rights is being transferred to The Buyer.
The Buyer agrees to make no claim of interest in the intellectual property rights of any of the services offered on igaming.domains.
Indemnification
The Buyer agrees to defend, indemnify and hold harmless igaming.domains, its parent company Monetise Internet Group Holdings Limited, its shareholders, directors and employees from any and all claims, demands, actions or proceedings and all liabilities, losses, damages, costs and expenses, including attorneys’ fees and court costs arising from The Buyer’s failure to perform any of The Buyer’s obligations to us in relation to the services we provide or from a breach by The Buyer of the terms of this Agreement.
The Buyer further agrees to defend, indemnify and hold harmless igaming.domains, its parent company Monetise Internet Group Holdings Limited, its shareholders, directors and employees from any and all claims arising from The Buyer’s infringement of any trademark or other proprietary right relating to The Buyer’s domain name registration or arising from any other third party claim, action or demand related to The Buyer’s domain name or its use thereof. This obligation shall survive the termination or expiration of this Agreement.
Limitation of Liability
The Buyer clearly understand and agree that in no event Monetise Internet Group Holdings Limited will be liable to The Buyer for any direct, indirect, incidental or consequential damage, including, but not limited to, damages for loss of profits, reputation, opportunity or data and/or for depletion of goodwill or any other intangible asset resulting from, but not limited to:
- The use or inability to use our services and/or igaming.domains site;
- Delays in the transmission or complete loss of data;
- Errors or misstatements in any of the information and/or services provided under this Agreement;
- Failure of any systems due to events within or beyond our control.
The Buyer acknowledges and agrees that The Buyer’s domain is subject to transfer, cancellation, suspensions or modification pursuant to the application to The Buyer’s domain registration of any relevant dispute policy, including, but not limited to those from UDRP, WIPO or any other policy adopted by ICANN or any other governmental or successor organisation, policies adopted by domain registrar companies and/or ccTLD registration authority organisations.
Disclaimer of Warranties
The services, information and data provided to The Buyer under this agreement and on igaming.domains site are provided as is and as available, without any warranties of any kind, whether express or implied, that the services, data and information, available on igaming.domains will meet The Buyer’s requirements or will be timely or error free. Monetise Internet Group Holdings Limited makes no warranty about the service quality and availability of our customer support agents.
No information obtained by The Buyer from any of shareholders, directors or employees at Monetise Internet Group Holdings Limited through any form of communication, whether oral or written, or through igaming.domains’s site shall create any warranty not expressly made with this Agreement.
Terms of Service Changes
These Terms and Conditions may be updated from time to time by Monetise Internet Group Holdings Limited to reflect changes in our practices and services. We will revise the date of the latest update on this page. The new version of our Terms and Conditions will be automatically effective 14 days after being published on igaming.domains.
